Official Contest Rules & Regulations of the Daily Grommet "Grommet Giveaway" ("Promotion")

Sponsored by Daily Grommet, Inc. ("Sponsor")

NO ENTRY FEE. NO PURCHASE NECESSARY TO ENTER OR WIN. The Promotion begins on December 29, 2008, and ends on December 31, 2009 ("Promotion Period"). Specific random drawing dates and deadlines for entry will be listed on the Daily Grommet site in the user comment section.

Eligibility: The Daily Grommet "Grommet Giveaway" Contest is open only to legal residents of the fifty United States and the District of Columbia who are at least eighteen (18) years old at the time of entry.

Employees of Sponsor, past employees of Sponsor, immediate family members of Sponsor's employees, or members of the household of any such employees, or employees of Sponsor's advertising, promotion, fulfillment or other coordinating agencies, or individuals providing services to Sponsor through an outsourcer or temporary employment agency during the Promotion, are not eligible to participate in this Promotion. By entering this Promotion, Participant agrees to these Official Contest Rules & Regulations (the "Official Rules") and the decisions of Sponsor, which are final and binding in all respects. This Promotion and any participation therein are void where restricted by federal, state, or local law. Winning a prize is contingent upon fulfilling all requirements set forth herein.

How to Enter: To enter the Promotion participant must either sign up for the Daily Grommet daily email or leave a comment in the Talk About this Grommet section of DailyGrommet.com, as detailed in the rules of the specific giveaway.

Only one submission per user. Once you win, you are not eligible to enter for 6 months.

By entering the Promotion, and as a condition of eligibility, Participant agrees to grant to Sponsor a non-exclusive, irrevocable, worldwide, royalty-free license to any and all intellectual property rights Participant may have relating to Participant’s Submission including but not limited to copyright, moral rights and a license for Sponsor to adapt, edit, modify, publish, promote, reproduce, distribute, publicly display and perform and make derivative works of Participant’s Submission in any and all media as Sponsor sees fit, to identify Participant as the author of the Submission and to authorize others to do any of the above without any obligation to compensate Participant.

Participant may not enter the Promotion with multiple email and/or multiple identities nor may Participant use any other device or artifice to obtain multiple registrations or entries. Any such actions may lead to disqualification.

No responsibility is assumed for lost, late, incomplete, stolen, misdirected, or illegible Submissions, email, or attempts to enter by email; or for any computer, telephone, cable, network, satellite, electronic or Internet hardware or software malfunctions, failures, connections, availability or garbled or jumbled transmissions, lack of Internet accessibility or availability, or technical failure of any kind.

In the event of a dispute as to any registration, the authorized account holder of the email address used to register will be deemed to be the registrant or player. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. The potential winner may be required to show proof of being the authorized account holder.

Prize Drawing: On various dates, to be announced on Daily Grommet.com in the user comment section, Daily Grommet, Inc. will randomly select the Contest winner from all eligible entries received during the Promotion Period. The winner will be notified by email within 48 hours of the end of the Promotion. The winner will also be publicly announced on dailygrommet.com.

The winner must continue to comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. In the event that the selected winner is disqualified for any reason, Sponsor will award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries. Only three (3) alternate drawings will be held after which the prize will remain unawarded.

Prize: Prize winner will receive various items, the value of which will be listed on DailyGrommet.com in the user comment section on promotion dates. The Prizes are not redeemable for cash.

Release: By receipt of any prize, winner agrees to release and hold harmless Sponsor and their respective subsidiaries, affiliates, suppliers, distributors, dealers, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company's officers, directors, employees and agents (collectively, the "Released Parties") from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Promotion or receipt or use or misuse of any prize.

Publicity: Except where prohibited, participation in the Promotion constitutes winner's consent to Sponsor's and its agents' use of winner's name, photograph, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or notification by any means, written or electronic.

General Conditions: Sponsor reserves the right to cancel, suspend and/or modify the Promotion, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor's reasonable control impairs the integrity or proper functioning of the Promotion, as determined by Sponsor in its sole discretion. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Promotion or to be acting in violation of these Official Rules or any other Promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Promotion may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

Limitations of Liability: Sponsor is not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Promotion; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) technical, human or other errors which may occur in the administration of the Promotion or the processing of entries; or (4) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Promotion or receipt or use or misuse of any prize. If for any reason an entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant's sole remedy is another entry in the Promotion, unless it is not possible to award another entry due to discontinuance of the Promotion, or any part of it, for any reason. Sponsor, at its discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein.

Governing Law: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of Massachusetts, U.S.A.

Personal Information: Sponsor may collect personal data about Participants online, in accordance with the Daily Grommet Privacy Policy. Please review the Daily Grommet privacy policy at http://www.dailygrommet.com/pages/privacy. By participating in the Promotion, Participant hereby agrees to Sponsor's collection and use of his/her personal information and acknowledge that he/she has read and accepted these Official Rules and the Daily Grommet Privacy Policy.
